(0.01-0.02 ORDERING FROM CYCLELIFE EAST DEVON)

0.01 All orders will be processed at time of receipt.

0.02 In order to expedite delivery, Cyclelife East Devon operates on a ‘real time’ basis and Customer orders are passed for packing immediately following processing. It is therefore not possible to ‘add’ to an order after it has been passed for processing. In this case, a complete second order will have to be made.

(1.01-1.02 CARRIAGE: CYCLELIFEEAST DEVON FOR THE UK ONLY)

1.01 All products are shipped weight and size depended of the product. If a sole product is purchased the shipping carriage will be displayed in the checkout under shipping costs. Any order containing multiple products may change the shipping carriage if the combined weigh or size over steps the variables or the shipment category. Shipment carriages are between £5.99 and £7.99 pound sterling from 18,11,2025.

1.02 Products which are not shippable and are collection only products include Bikes and Electric bikes. Store only products which are not displayed on www.cyclelifeeastdevon.com . Some products may change optional shipping methods from time to time, which may incur a carriage fee which will be displayed as a mandatory option in the checkout.

(2.01-2.11 DELIVERY)

2.01 Every attempt is made to deliver within 3 to 4 working days, for all orders received no later than 2.00pm of the completed order request. Any order made passed 12.00pm on Friday may incur an extended 2 days extension for delivery.

2.02 Some orders may arrive quicker than the expected delivery time. In this case once an order is processed and with the courier company, you will receive delivery options from us or the courier company directly.

2.03 Unfortunately, it is not possible to provide this level of service for those of our Customers in more remote regions of the United Kingdom, where an up to three-working day extension to delivery may occur. Equally, due to daily demands during peak season, we may not always be able to maintain our levels of service but rest assured of our commitment to despatch as quickly as possible.

2.04 Products marked Availability: (on order) are products ordered from suppliers once a purchase has be made at www.cyclelifeeastdevon.com . We carry out daily checks of stock levels from suppliers and update our product availability accordingly to availability. Although it is unlikely, we cannot guarantee a product may go out of stock from a supplier before we update our site and a purchase is made for that product on our site. In this case we will contact you to offer you a full refund of that product at the purchase price or to provide you an estimated delivery date if the product is due to become available in stock again. (Remarks 2.4 is a mandatory to the Terms and Conditions agreement ticked signed for in the checkout).

2.05 For pre orders and products out of stock, product availability dates are liable to change, reduce or extend as a result of product demand. For these products we will contact you to inform you of the change. If a pre-order product or out of stock product is delayed by up to a 64 day extension of the due in stock date, we will not provide a refund for the delay. If it exceeds the 64 extension delay we will contact you to offer a full refund at the purchase price or to provide a new estimated availability date.

2.06 If an order is lost in transit from the courier company, we can not be held responsible for the delay. Once details have been established from the courier company of the order not arriving at the destination, we will arrange for a replacement order to be sent out if this is foreseeable within up to 14 days of conformation of the lost item.

2.07 The Customer shall not rely on any delivery date given by Cyclelife East Devon and shall not enter into any contract (whether for the supply of goods or services) under which it may be in breach or suffer any legal disadvantage in the event that the order is not delivered on the stated delivery date.

2.08 Customer orders are not accompanied by any paperwork unless specifically requested otherwise by email. A despatch note and/or invoice are sent electronically by email in advance of you receiving the delivery, and upon conformation of the delivery arriving at it's destination by the courier company. The despatch note details the contents of the order in full, enabling Customers to check orders upon receipt. The items detailed on the invoice, will be the items Customers are charged for, which includes cost details.

2.09 Delivery will be made by our appointed carriers or by post. Reasonable Endeavours will be made to execute orders in one consignment.

2.10 Items which fall under separate delivery options will have to be purchased under separate orders, You will not be able to make a payment in this case and guidance will be provided at the checkout to purchase separately depending what items are in the basket (order 1) and (order 2).

2.11 In the event of incomplete availability, subsequent deliveries will be shipped carriage paid.

(3.01-3.07 DAMAGES, SHORTAGES, NON-DELIVERY & PRICE QUERIES)

3.01 We will not accept any claim in respect of damage in transit, shortage or non-delivery unless it is communicated to Cyclelife East Devon as follows: 1. For damage in transit - within 3 days of the receipt of goods 2. For shortages - within 3 days of the receipt of goods 3. For non-delivery - within 10 days of the date of the invoice 4. For Price Queries - within 3 days of the receipt of invoice.

3.02 We regret that notifying any of our staff other than a member of the Customer Care Team does not constitute ‘notice’.

3.03 No deduction from the payment of invoices may be made for goods damaged, not received or where there is a price dispute unless specified in the terms and conditions.

3.04 If all or part of a consignment is refused due to damage, the relevant Customer Care Team must be notified immediately upon operating hours.

3.05 Damaged parcels received by post should not be refused, but accepted and the Customer Care Team notified immediately.

3.06 All our shipped courier services are photo and signed for, In the event that an order is not delivered, we will contact the courier company for proof of delivery and or the customers delivery options choice.

3.07 If an order is lost as a result of delivery option chosen from the courier, which results in the delivery being left and not signed for. We will not provide any compensation for the lose of good or delivery unless the lose of goods is a result of the courier company braking contract. In this case compensation may be delayed whilst an internal investigation is carried out.

(4.01-4.03 PRE-ORDERS/GOODS AWAITING DESPATCH)

4.01 For goods not available ex-stock or pre-orders at time of order placement will be automatically despatched once the goods are available, given that the order is within payment terms at that time. Carriage will be paid by Cyclelife East Devon only for delayed dispatch items and does not include pre ordered product. If a delay on a pre order product incurs passed the specified availability date and is within the terms or contract, Cyclelife will cover any increase in shipping costs if occur from the date of invoice at which point our standard delivery terms and conditions at the time of despatch will prevail.

4.02 Cancellations cannot be accepted following the despatch of the goods.

4.03 In all instances, any expected future availability dates made available to the Customer are based upon the best information available at that time and are open to change due to supplier stock supply.

(5.01-5.12 CUSTOMER CARE)

5.01 If accepted as faulty, goods will be replaced or a full refund issued within 14 working days of receipt.

5.02 A full refund will only be issued where replacement parts are not available.

5.03 Products, which we do not believe to have been purchased from ourselves, will be rejected unless proof of purchase can be provided.

5.04 Where refunds are issued they will be at the price prevailing at the time of refund.

5.05 No member of Cyclelife East Devon personnel is empowered to offer replacement parts or credit other than the Customer Care Team, and then only after thorough examination by the Warranty Department.

5.06 It is the responsibility of the customer to meet the cost of returning warranty goods and is allowed for within our original pricing. This policy has been adopted to negate abuse of this service and the subsequent costs, which we would then have to pass on to all of our customers. We will as always, reimburse the Customer for the cost of returning goods, where proven that the cause for return is due to error or negligence on the part of Cyclelife East Devon at the time of processing or despatch.

5.07 All returns are examined to the specifications laid down by the original suppliers of each brand. Failure to meet their criteria would obviously negate any refund and impact upon product pricing.

5.08 Any consumer claim in the first instance should be referred back to Cyclelife East Devon who is responsible for resolving the claim with the consumer.

5.09 Cyclelife East Devon (to the extent not inconsistent with these “terms and conditions” and permitted by law where inconsistent) with current legislation as set out within the Supply of Goods Act 1979, Sale of Goods Act 1893, Sale of Goods and Supply of Services Act 1980, Electronic Commerce Act 2000 and the Consumer Rights Act 2022 and the Consumer Protection Act [1987].

5.10 Subject to applicable law, Cyclelife East Devon shall not be liable for any damage caused to third party property arising from the functioning or use of the goods.

5.11 Any returns sent to other business addresses, other than the Returns address provided if needed, will be charged carriage for the transfer to the correct address.

5.12 Any good stock returns will incur a 10% handling charge. They must also be returned in original undamaged packaging in a re-saleable state.

(6.01-6.01 SPECIFICATIONS)

6.01 Cyclelife East Devon reserve the right without notice and without affecting the validity of any contract with the customer to modify specifications of goods according to the supply position and our ongoing desire to improve the specification. If a product specification has a set change, we will make every effort to keep the product specifications up to date inline with the suppliers information provided.

(7.01-7.02 PRICING)

7.01 Cyclelife East Devon reserves the right to alter prices without prior notice. Orders are accepted on the basis of prices ruling upon the time of purchase. This applies irrespective of any prices a Customer may quote on their order or that may be listed at time of receipt of the order.

7.02 From time to time Cyclelife East Devon may make special promotions available to its customers. Any prices which apply to these promotions are only available on orders submitted to Cyclelife East Devon within the terms and before the ‘Closing Date’ detailed thereupon. For the majority of promotions prices apply at date of processing and not date of despatch only when using the special offer forms and processes provided.

(8.01-8.03 RETENTION OF TITLE / RISK & TITLE)

8.01 The risk in the Goods shall pass to the Customer upon delivery.

8.02 Title to each item of the Goods shall not pass to the Customer until Cyclelife East Devon has received payment in full (in cash or cleared funds) for the goods.

8.03 If before title to the Goods passes to the Customer the Customer becomes subject to any Insolvency Event, or Cyclelife East Devon reasonably believes that any such Insolvency Event is about to happen and notifies the Customer accordingly, then, provided that the Goods have not been resold, or irrevocably incorporated into another product, and without limiting any other right or remedy Madison & Sportline may have.

Cyclelife East Devon may at any time:

1. Require the Customer to deliver up all goods in it’s possession to which title has not passed to the Customer.

2. And if the Customer fails to do so promptly, enter any premises of the Customer or of any third party where the goods are stored in order to recover them.

(9.01-9.08 PAYMENT TERMS)

9.01 All invoices are due for payment at the point of purchase, This includes pre order products.

9.02 A invoice will be supplied upon point of purchase via email.

9.03 All online payments can only be made on a debit or credit card.

9.04 All payments for products collected in store can be made using debit or credit card and cash payments upto £150.00.

9.05 In store cash payments between £150.00 and £1000.00 may be subject to processing delays. In store payments will not be accepted above £1000.00 due to new coming cash movement regulations.

9.06 Payment and discount terms may be reduced without prior notice within current subject to terms and conditions.

9.07 Once a payment has been made for a pre order product, a full refund can not be made for the agreed contract, unless it falls within subject of the terms and conditions signed for upon the date and time of purchase.

9.08 In the event that a bank transfer needs to be made to Cyclelife East Devon, we will accept no responsibility for the misappropriation of transfer made out to any other payee. The risk related to transfer lies with the Customer until the debt has been paid into the bank account and the debt total has been cleared.

(10.01-10.02 LIMITED DISTRIBUTION)

10.01 From time to time products may be made available through limited distribution and pre order. This is dependent upon the requirements of the brand and the ability of the supply chain to meet demand.

10.02 Cyclelife East Devon only ensure the products it distributes meet the legal requirements of the countries where we are actively selling. Full responsibility lies with the customer for any application, modification or re sale upon receiving the product.

(11.01-11.01 ONLINE MARKETPLACE CLAUSE)

11.01 The product is the sole responsibility of the customer upon receiving the order and all products sold by Cyclelife East Devon are forbidden to be re sold on any online market place including but not limited to Amazon or eBay. In the event that Cyclelife East Devon suspects that such an event may or has happened. Cyclelife East Devon reserves the right to suspend any further sales and or contracts with the customer.

(12.01-12.03 INTELLECTUAL PROPERTY)

12.01 Cyclelife East Devon reserves the right to withdraw your permission to use all brand intellectual property on the brands supplied by them, including imagery, trademarks or other branding if your use of them is deemed to be brand damaging.

12.02 You must comply at all times with the Brand Guidelines of products sold by Cyclelife East Devon, as in force and notified to you on an ongoing basis.

12.03 Cyclelife East Devon reserves the right to withdraw access to the brands supplied at any point if it is shown you are in breach of the Brand Guidelines.

(13.01-13.01 POINT OF SALE)

13.01 All products remain the property of Cyclelife East Devon up till the point of sale, unless it posses a breach of contract under subject of the terms and conditions agreed to at the date and time of purchase.

(14.01-14.03 APPLICATION LAW)

14.01 If any provision of these terms and conditions are held to be unenforceable or illegal, in whole or in part, such provision or part shall to that extent be deemed not to form part of these terms and conditions but the enforceability of the remainder of these terms and conditions shall remain unaffected.

14.02 These terms and conditions and any dispute or claim arising out of or in connection with them or the subject matter or formation (including noncontractual disputes and claims) are governed by, and shall be construed in accordance with, British law.

14.03 These terms and conditions are subject to the non-exclusive jurisdiction of the of the Courts of England in relation to any matter, dispute or claim arising out of or in connection with these terms and conditions, its implementation or effect or in relation to its existence or validity (including non-contractual disputes or claims).
